Andrew Johnson and the Legacy of the Civil War

Perhaps no other American leader has experienced so precipitous a fall from grace as Andrew Johnson, seventeenth president of the United States (1865–1869). During the Civil War, Johnson was the preeminent symbol of Southern Unionism—and thus, the ideal running mate for Abraham Lincoln in the 1864 election, on the Union Party ticket. Four years later, as president, he was widely viewed as a traitor to his political allies and even to the Union, and barely escaped impeachment. In modern scholarship, the image persists of Johnson as politically inept, and willfully self-destructive—driven by visceral emotions, particularly by implacable racism, and lacking in Lincoln’s skill for reading and molding public opinion. But such an image fails to capture fully the scope of his political influence. As President, Johnson staked claims that shaped the course of Reconstruction—that emancipation signified nothing but freedom; that the immediate aftermath of the Civil War was a golden moment of reconciliation, which Radicals squandered by pushing for black suffrage; that the Congressional program of Reconstruction inaugurated a period of so-called “black rule,” during which former Confederates were victimized and disfranchised. Such propaganda was designed to deem the Republican experiment in black citizenship a failure before it even began. Johnson’s term offers an example as striking as any in U.S. history of the power of presidents to set the terms of political debates—and of the power of their words to do lasting harm.

The Anti-Chinese Massacre in Los Angeles as a Reconstruction-Era Event

Long regarded as a violent outburst significant mainly for California history, the 1871 Los Angeles anti-Chinese massacre raises themes central to America’s Civil War Reconstruction era between 1865 and 1877, namely, the resort to threats and violence to preserve traditionally conceived social and political authority and power. Although the Los Angeles events occurred far from the American South, the Los Angeles anti-Chinese massacre paralleled the anti-black violence that rose in the South during Reconstruction. Although the immediate causes of the violence in the post–Civil War South and California were far different, they shared one key characteristic: they employed racial disciplining to preserve traditional social orders that old elites saw as threatened by changing times and circumstances.

Banking and Finance from the Revolution to the Civil War

In creating a new nation, the United States also had to create a financial system from scratch. During the period from the Revolution to the Civil War, the country experimented with numerous options. Although the Constitution deliberately banned the issuance of paper money by either Congress or the states, states indirectly reclaimed this power by incorporating state-chartered banks with the ability to print banknotes. These provided Americans with a medium of exchange to facilitate trade and an expansionary money supply to meet the economic needs of a growing nation. The federal government likewise entered into the world of money and finance with the incorporation of the First and Second Banks of the United States. Not only did critics challenge the constitutionality of these banks, but contemporaries likewise debated whether any banking institutions promoted the economic welfare of the nation or if they instead introduced unnecessary instability into the economy. These debates became particularly heated during moments of crisis. Periods of war, including the Revolutionary War, the War of 1812, and the Civil War, highlighted the necessity of a robust financial system to support the military effort, while periods of economic panic such as the Panic of 1819, the Panics of 1837 and 1839, and the Panic of 1857 drew attention to the weaknesses inherent in this decentralized, largely unregulated system. Whereas Andrew Jackson succeeded in destroying the Second Bank of the United States during the Bank War, state-chartered commercial banks, savings banks, and investment banks still multiplied rapidly throughout the period. Numerous states introduced regulations intended to control the worst excesses of these banks, but the most comprehensive legislation occurred with the federal government’s Civil War-era Banking Acts, which created the first uniform currency for the nation.

The Black Freedom Struggle in the Urban North

Racism in the United States has long been a national problem, not a regional phenomenon. The long and well-documented history of slavery, Jim Crow laws, and racial violence in the South overshadows the persistent reality of racial discrimination, systemic segregation, and entrenched inequality north of the Mason-Dixon line. From the mid-19th century forward, African Americans and their allies mounted a series of challenges to racially separate schools, segregated public accommodations, racially divided workplaces, endemic housing segregation, and discriminatory policing. The northern civil rights movement expanded dramatically in the aftermath of the Great Migration of blacks northward and the intensification of segregation in northern hotels, restaurants, and theaters, workplaces, housing markets, and schools in the early 20th century. During the Great Depression and World War II, emboldened civil rights organizations engaged in protest, litigation, and lobbying efforts to undermine persistent racial discrimination and segregation. Their efforts resulted in legal and legislative victories against racially separate and unequal institutions, particularly workplaces and stores. But segregated housing and schools remained more impervious to change. By the 1960s, many black activists in the North grew frustrated with the pace of change, even as they succeeded in increasing black representation in elected office, in higher education, and in certain sectors of the economy. In the late 20th century, civil rights activists launched efforts to fight the ongoing problem of police brutality and the rise of the prison-industrial complex. And they pushed, mostly through the courts, for the protection of the fragile gains of the civil rights era. The black freedom struggle in the North remained incomplete in the face of ongoing segregation, persistent racism, and ongoing racial inequality in employment, education, income, and wealth.

Business in the Civil War: Trade, Markets, and Industry

The Civil War disrupted domestic and international trade. Union strategy included a considerable focus on economic warfare, especially in the form of a naval blockade of Southern ports. Because the war lasted four years, its outcome was affected deeply by the success or failure of Union and Confederate economic mobilizations of capital, industry, and labor. On the home fronts, many businesses, large and small, confronted new challenges to their normal operations and supply chains. Generally speaking, businesses in the South suffered more than their Northern counterparts. Forced to deal with the consequences of the blockade, high inflation, and Union advances, many Southern farmers, merchants, and manufacturers struggled to keep afloat, especially after 1862. In the North, there was more wartime prosperity, thanks to a smoother economic mobilization and the Union’s ability to continue internal and international trade. But there was no single uniform experience: at the levels of specific industries and individual firms, the impact of the war varied widely. Clearly, the single biggest economic change—and political and social change, as well—was the end of slavery. Beyond that, the Civil War’s effects on long-run economic and industrial development were more complex and uncertain. The conflict’s heavy costs in blood and treasure harmed the North as well as the South, but many industries came out of the war in a strong enough position to allow the United States to continue on its path to becoming the world’s largest and most prosperous national economy by the end of the 19th century.

The Civil War in an Atlantic Context

America’s Civil War became part of a much larger international crisis as European powers, happy to see the experiment in self-government fail in America’s “Great Republic,” took advantage of the situation to reclaim former colonies in the Caribbean and establish a European monarchy in Mexico. Overseas, in addition to their formal diplomatic appeals to European governments, both sides also experimented with public diplomacy campaigns to influence public opinion. Confederate foreign policy sought to win recognition and aid from Europe by offering free trade in cotton and aligning their cause with that of the aristocratic anti-democratic governing classes of Europe. The Union, instead, appealed to liberal, republican sentiment abroad by depicting the war as a trial of democratic government and embracing emancipation of the slaves. The Union victory led to the withdrawal of European empires from the New World: Spain from Santo Domingo, France from Mexico, Russia from Alaska, and Britain from Canada, and the destruction of slavery in the United States hastened its end in Puerto Rico, Cuba, and Brazil.

Contraband Camps and the African American Refugee Experience during the Civil War

In May 1861, three enslaved men who were determined not to be separated from their families ran to Fort Monroe, Virginia. Their flight led to the phenomenon of Civil War contraband camps. Contraband camps were refugee camps to which between four hundred thousand and five hundred thousand enslaved men, women, and children in the Union-occupied portions of the Confederacy fled to escape their owners by getting themselves to the Union Army. Army personnel had not envisioned overseeing a massive network of refugee camps. Responding to the interplay between the actions of the former slaves who fled to the camps, Republican legislation and policy, military orders, and real conditions on the ground, the army improvised. In the contraband camps, former slaves endured overcrowding, food and clothing shortages, poor sanitary conditions, and constant danger. They also gained the protection of the Union Army and access to the power of the US government as new, though unsteady, allies in the pursuit of their key interests, including education, employment, and the reconstitution of family, kin, and social life. The camps brought together actors who had previously had little to no contact with each other, exposed everyone involved to massive structural forces that were much larger than the human ability to control them, and led to unexpected outcomes. They produced a refugee crisis on US soil, affected the course and outcome of the Civil War, influenced the progress of wartime emancipation, and altered the relationship between the individual and the national government. Contraband camps were simultaneously humanitarian crises and incubators for a new relationship between African Americans and the US government.

The Draft in U.S. History

The issue of compulsory military service has been contested in the United States since before its founding. In a nation characterized by both liberalism and republicanism, there is an inherent tension between the idea that individuals should be able to determine their own destiny and the idea that all citizens have a duty to serve their country. Prior to the 20th century, conscription occurred mainly on the level of local militias, first in the British colonies and later in individual states. It was during the Civil War that the first federal drafts were instituted, both in the Union and the Confederacy. In the North, the draft was unpopular and largely ineffective. Congress revived national conscription when the United States entered World War I and established the Selective Service System to oversee the process. That draft ended when U.S. belligerency ended in 1918. The first peacetime draft was implemented in 1940; with the exception of one year, it remained in effect until 1973. Its most controversial days came during the Vietnam War, when thousands of people across the country demonstrated against it and, in some cases, outright refused to be inducted. The draft stopped with the end of the war, but in 1980, Congress reinstated compulsory Selective Service registration. More than two decades into the 21st century, male citizens and immigrant noncitizens are still required to register within thirty days of their eighteenth birthday. The very idea of “selective service” is ambiguous. It is selective because not everyone is conscripted, but it is compulsory because one can be prosecuted for failing to register or to comply with orders of draft boards. Especially during the Cold War, one of the system’s main functions was not to procure soldiers but to identify and exempt from service those men best suited for other endeavors framed as national service: higher education, careers in science and engineering, and even supporting families. That fact, combined with the decentralized nature of the Selective Service System itself, left the process vulnerable to the prejudices of local draft boards and meant that those most likely to be drafted were poor and nonwhite.

Economic Thought and Practice in America

The conspicuous timing of the publication of Adam Smith’s The Wealth of Nations and America’s Declaration of Independence, separated by only a few months in 1776, has attracted a great deal of historical attention. America’s revolution was in large part motivated by the desire to break free from British mercantilism and engage the principles, both material and ideological, found in Smith’s work. From 1776 to the present day, the preponderance of capitalism in American economic history and the influence of The Wealth of Nations in American intellectual culture have contributed to the conventional wisdom that America and Smith enjoy a special relationship. After all, no nation has consistently pursued the tenets of Smithian-inspired capitalism, mainly free and competitive markets, a commitment to private property, and the pursuit of self-interests and profits, more than the United States. The shadow of Smith’s The Wealth of Nations looms large over America. But a closer look at American economic thought and practice demonstrates that Smith’s authority was not as dominant as the popular history assumes. Although most Americans accepted Smith’s work as the foundational text in political economy and extracted from it the cardinal principles of intellectual capitalism, its core values were twisted, turned, and fused together in contorted, sometimes contradictory fashions. American economic thought also reflects the widespread belief that the nation would trace an exceptional course, distinct from the Old World, and therefore necessitating a political economy suited to American traditions and expectations. Hybrid capitalist ideologies, although rooted in Smithian-inspired liberalism, developed within a dynamic domestic discourse that embraced ideological diversity and competing paradigms, exactly the kind expected from a new nation trying to understand its economic past, establish its present, and project its future. Likewise, American policymakers crafted legislation that brought the national economy both closer to and further from the Smithian ideal. Hybrid intellectual capitalism—a compounded ideological approach that antebellum American economic thinkers deployed to help rationalize the nation’s economic development—imitated the nation’s emergent hybrid material capitalism. Labor, commodity, and capital markets assumed amalgamated forms, combining, for instance, slave and free labor, private and public enterprises, and open and protected markets. Americans constructed different types of capitalism, reflecting a preference for mixtures of practical thought and policy that rarely conformed to strict ideological models. Historians of American economic thought and practice study capitalism as an evolutionary, dynamic institution with manifestations in traditional, expected corners, but historians also find capitalism demonstrated in unorthodox ways and practiced in obscure corners of market society that blended capitalist with non-capitalist experiences. In the 21st century, the benefits of incorporating conventional economic analysis with political, social, and cultural narratives are widely recognized. This has helped broaden scholars’ understanding of what exactly constitutes capitalism. And in doing so, the malleability of American economic thought and practice is put on full display, improving scholars’ appreciation for what remains the most significant material development in world history.

Federalism refers to the constitutional and political structure of the United States of America, according to which political power is divided among multiple levels of government: the national level of government (also referred to as the “federal” or “general” government) and that of the states. It is a multilayered system of government that reserves some powers to component entities while also establishing an overarching level of government with a specified domain of authority. The structures of federalism are set forth in the Constitution of the United States, although some related ideas and practices predated the founding period and others have developed since. The balance between federal and state power has shifted throughout U.S. history, with assertions of broad national power meeting challenges from supporters of states’ rights and state sovereignty. Federalism is a fundamental value of the American political system, and it has been a controversial political and legal question since the founding period.

The Freedmen’s Bureau

On March 3, 1865, President Abraham Lincoln signed into law a bill creating the Bureau of Refugees, Freedmen, and Abandoned Lands, better known as the Freedmen’s Bureau. Congress granted the bureau control over affairs relating to the formerly enslaved people in the Confederate States and also charged it with administering relief to war refugees and managing the confiscated and abandoned land in federal possession. In theory, its agents would transform the habits and beliefs associated with slavery into those that prevailed in the free states of the North. Practical challenges abounded, and the original view that the intervention would be brief proved to be naïve. Complicating matters, Lincoln’s successor, Andrew Johnson, viewed the bureau as a bone of contention in his dispute with Congressional Republicans over which branch of government would control Reconstruction, the process of returning the seceded states to full standing in national affairs. Overriding Johnson’s vetoes, Congress extended the bureau’s mandate, first to 1868 and eventually to 1872. From the beginning, Southern critics accused the bureau of creating labor strife and stirring hatred between the races, a characterization that formed a central plank in later Lost Cause mythology regarding the evils of Reconstruction. Only decades into the 20th century did historians succeed in rehabilitating the reputation of this pioneering federal agency and its important contributions to restoring stability to the Southern economy and assisting formerly enslaved Southerners in asserting their rights as free and equal citizens of the republic.

The Great Railroad Strike of 1877

The “Great Railroad Strike,” the first and largest nationwide series of labor uprisings in the United States’ history, occurred in July and August 1877. Backdropped by the Long Depression emanating from the Panic of 1873, the collapse of federal Reconstruction in the South, and the cooperation and consolidation among owners of major industries, what became known as the “Great Strike” or the “Great Upheaval” was in fact a sequence of dozens of simultaneous and overlapping strike actions in which some 500,000 workers across various industries walked off their jobs. Many couched their struggle in a language of freedom centered on economic independence, appealing to other workers and the public through the ideology of labor republicanism. In addition to general strikes in some cities, labor actions shut down the nation’s most valuable and important industry, the railroads. At the same time, cross-class urban crowds protested urban and industrial conditions, skirmished with soldiers, and destroyed corporate property. Strike conduct was specific to trunk line and locale. Local political, ethnic, cultural, and kinship networks impacted worker action, as did the newspaper media. Likewise, civic responses to the strikes varied widely and were both shaped by, and helped shape, municipal and regional politics. Community, cross-trade, and cross-class support proved critical in places where the strikes were most far-reaching. The roots of the 1877 strikes lay in cumulative antagonism between railroad workers and owners. In an era when workplace accidents killed tens of thousands of workers and maimed hundreds of thousands more every year, railroad companies refused to equip workplaces with readily available safety devices. Employee grievances also included long and irregular working hours, low pay, and the absence of collective bargaining rights. However, the strikes themselves and the accompanying crowd actions that began on July 16 were instigated by workers on the Baltimore and Ohio Railroad in response to a series of wage reductions. A wave of stoppages and protests quickly spread outward along the rail lines to Baltimore, Pittsburgh, Buffalo, Chicago, Kansas City, and San Francisco, transforming from a railway strike to a more general labor and urban uprising. The episode reached its most radical zenith in St. Louis, where the shutdown of nearly all of the city’s industry, largely coordinated by the Workingmen’s Party of the United States, made it the first truly general strike in U.S. history. Workers outside the railyards and non-wage workers also participated in urban uprisings and the destruction of railroad property. Cities saw violent clashes between crowds and private police forces and militias, National Guard units, and federal soldiers. In all, over one hundred men, women, and children were killed in the violence. The strikes had profound implications in the areas of labor management, civil–military relations, and popular attitudes regarding capitalism, socialism, and labor organization. The quelling of the strikes led to new approaches in how city and state governments handled civil unrest. In particular, the strikes expanded ownership’s labor management instruments and practices, as governments proved willing to deploy the military against workers during labor disputes on a major scale, expediting the rise of the “robber baron.” These repressive measures were augmented by popular anticommunist hysteria—the first of several major “red scares” throughout U.S. history. Whereas many workers viewed the walkouts as prefiguring a “second American Revolution” or a culminating “emancipation of labor,” building on the implicit promises of the Civil War, business elites and political authorities were frightened as perhaps no time in U.S. history. Economic crisis and scarcity fears enabled politicians and sensationalist newspapermen to create and exploit popular fears of foreign-born radicalism. Apprehensions concerning labor organization, tinged with xenophobia, permeated the upper and middle classes, furthering a sea change in national political priorities. Meanwhile, although organized labor, limited to “skilled” rail workers, had been in decline throughout the 1870s, the Great Strike’s lack of coordination alerted many workers to the need for expanded cooperation in the form of unionization. Occurring at the tail end of Reconstruction, the Great Railroad Strike helped shift the center of political gravity in the nation from questions of political rights in the post-emancipation South to those of capital and labor in the industrial North. Most historians view the Great Strike as a watershed event. As a cultural transit from Reconstruction to the Gilded Age, 1877 forced the “labor question” into the nation’s popular consciousness.

Indigenous Peoples and Euro-American Frontiers, Borderlands, and Borders in North America

On July 27, 1882, a group of at least seventy-five “Turtle Mountain Indians from Canada” crossed the US–Canada border near Pembina, Dakota Territory, ordered white settlers off the land, and refused to pay customs duties assessed against them. “We recognize no boundary line, and shall pass as we please,” proclaimed their leader, Chief Little Shell. Native to the Red River region long before the Treaty of 1818 between the United States and Great Britain drew imaginary cartographies across the region or the 1872 International Boundary Survey left physical markers along the 49th parallel, Little Shell’s Chippewas and Métis navigated expansive homelands bounded by the natural environment and surrounding Native peoples, not arbitrary latitudinal coordinates. Over a century later, Indigenous leaders from the United States, Canada, and Mexico formed the Tribal Border Alliance and hosted a “Tribal Border Summit” in 2019 to assert that “Tribes divided by international borders” had natural inherent and treaty-bound rights to cross for various purposes. These Indigenous sentiments, expressed over centuries, reveal historic and ongoing conflicts born from the inherent incongruity between Native sovereignty and imposed non-Native boundaries and restrictions. Issues of land provide a figurative bedrock to nearly all discussion of interactions between and boundary making by non-Native and Native peoples in North America. Indigenous lands and competing relations to it, natural resources and contest over their control, geography and territoriality: these issues underpin all North American history. Adjacent to these more familiar topics are complex stories of boundaries and borders that were imposed, challenged, ignored, violated, or co-opted. Native histories and experiences at the geographic edges of European empires and nation-states uncover rough and untidy processes of empire-building and settler colonial aspirations. As non-Natives drew lines across maps, laying claim to distant Indigenous lands, they also divided the same in arbitrary manners. They rarely gave serious consideration to Native sovereignty or rights to traditional or evolving relationships to homelands and resources. It is a wonder, therefore, that centuries of non-Natives have been surprised when Indigenous peoples refused to recognize the authority of imposed borders or co-opted their jurisdictional “power” for their own uses. Surveying examples of Indigenous peoples and their histories across imposed boundaries in North America forces historians to ask new questions about intercultural exchange, geopolitical philosophies, and the histories of nations, regions, and peoples. This is a worthy, but complex, pursuit that promises to greatly enrich all intersecting topics and fields.

Ireland-US Relations

Irish and American histories are intertwined as a result of migration, mercantile and economic connections, and diplomatic pressures from governments and nonstate actors. The two fledgling nations were brought together by their shared histories of British colonialism, but America’s growth as an imperial power complicated any natural allegiances that were invoked across the centuries. Since the beginnings of that relationship in 1607 with the arrival of Irish migrants in America (both voluntary and forced) and the building of a transatlantic linen trade, the meaning of “Irish” has fluctuated in America, mirroring changes in both migrant patterns and international politics. The 19th century saw Ireland enter into Anglo-American diplomacy on both sides of the Atlantic, while the 20th century saw Ireland emerge from Britain’s shadow with the establishment of separate diplomatic connections between the United States and Ireland. American recognition of the newly independent Irish Free State was vital for Irish politicians on the world stage; however the Free State’s increasingly isolationist policies during the 1930s to 1950s alienated its American allies. The final decade of the century, however, brought America and Ireland (including both Northern Ireland and the Republic of Ireland) closer than ever before. Throughout their histories, the Irish diasporas—both Protestant and Catholic—in America have played vital roles as pressure groups and fundraisers. The history of American–Irish relations therefore brings together governmental and nonstate organizations and unites political, diplomatic, social, cultural, and economic histories which are still relevant today.

Irregular and Guerrilla Warfare during the Civil War

Irregular and guerrilla warfare decisively shaped the course, consequences, and nature of the American Civil War. As Confederate irregular efforts intensified, so deepened the level and tenacity of the US war against increasingly large portions of the Confederate South. While never fully committed, supported, or thorough, the Confederacy waged an irregular war in pockets of the South that ultimately backfired. The irregular war forced a harder, and, in some places, total war upon the Confederate civilian population, which brought the war to an end faster and indelibly shaped the nature of the larger conflict. Supporters of the United States—Unionists—lived throughout the South, and they formed something of a fourth theater of war by foisting upon the Confederacy their own internal civil war from Texas to North Carolina, one that was intricately connected to the larger irregular war. Civilians rapidly became a significant focus of the guerrilla war, and those living in the wartime South found themselves in a years-long fight for survival. In a manner of speaking, they became combatants. In the end, the irregular war alone might not have decided the Civil War’s outcome, but it helped redefine the course and consequences of the larger conflict.

Jews in the US Armed Forces

Jewish service in the American military parallels that of many other Americans. Jews have served in colonial militias, in the American Revolution, and in all American military conflicts since the establishment of the country. In the United States’ early years, the total number of Jewish military personnel, like the Jewish population of the country as a whole, was very small. As the size of the American Jewish population grew during the late 19th and early 20th centuries, however, so did the number of Jews who served in the American Armed Forces. Jews responded to the country’s calls to arms alongside other Americans, even as they faced challenges that differentiated them from their compatriots. Like other racial, ethnic, and religious minority groups, Jews had to struggle against prejudices in the military, and like other immigrant communities, they have sometimes had to balance patriotism against transnational ties. Jews in the United States, however, always understood military service as part of the bargain of modern citizenship. They volunteered for service and responded to calls for conscription in order to fulfill their responsibilities as citizens, and they used military service both to express their commitment to the United States and to assert their rights as equal members of American society.

Juneteenth and Emancipation Celebrations

Emancipation celebrations in the United States have been important and complicated moments of celebration and commemoration. Since the end of the slave trade in 1808 and the enactment of the British Emancipation Act in 1834 people of African descent throughout the Atlantic world have gathered, often in festival form, to remember and use that memory for more promising futures. In the United States, emancipation celebrations exploded after the Civil War, when each local community celebrated their own experience of emancipation. For many, the commemoration took the form of a somber church service, Watch Night, which recognized the signing of the Emancipation Proclamation on January 1, 1863. Juneteenth, which recognized the end of slavery in Texas on June 19, 1865, became one of the most vibrant and longstanding celebrations. Although many emancipation celebrations disappeared after World War I, Juneteenth remained a celebration in most of Texas through the late 1960s when it disappeared from all cities in the state. However, because of the Second Great Migration, Texans transplanted in Western cities continued the celebration in their new communities far from Texas. In Texas, Juneteenth was resurrected in 1979 when state representative, later Congressman, Al Edwards successfully sponsored a bill to make Juneteenth a state holiday and campaigned to spread Juneteenth throughout the country. This grassroots movement brought Juneteenth resolutions to forty-six states and street festivals in hundreds of neighborhoods. Juneteenth’s remarkable post-1980 spread has given it great resonance in popular culture as well, even becoming a focus of two major television episodes in 2016 and 2017.

Military Strategy in the Civil War

Despite the absence of a robust and well-articulated conception of strategy, American military and political leaders during the Civil War had an intuitive sense of how military operations should be coordinated with larger political ends. They also shared a general adherence to the straightforward strategic ideas of Antoine-Henri de Jomini, who emphasized the importance of concentrating one’s own military forces in opposition to dispersed opponents. In the case of the Union, however, victory would require not only a more sophisticated conception of strategy that superseded Jomini and coordinated military operations in geographically disconnected fronts but also the practical implementation of such ideas through well-selected subordinate commanders. It would take Ulysses S. Grant until the end of the war to complete all these tasks. In the case of the Confederacy, secessionist leaders faced the challenge of prioritizing different theaters in the face of their material inferiority to the Union. Robert E. Lee chose the plausible strategy of striking directly at Northern public opinion with aggressive operations waged by his own Army of Northern Virginia, but the final failure of the Confederate war effort raises fair questions about whether the Confederacy should have paid more attention to its western theater.

The Northern Homefront

During the Civil War, the entire North constituted the homefront, an area largely removed from the din and horror of combat. With a few exceptions of raids and battles such as Gettysburg, civilians in the North experienced the war indirectly. The people on the homefront mobilized for war, sent their menfolk off to fight, supplied the soldiers and the army, coped without their breadwinners, and suffered the loss or maiming of men they loved. All the while, however, the homefront was crucially important to the course of the war. The mobilization of northern resources—not just men, but the manufacture of the arms and supplies needed to fight a war—enabled the North to conduct what some have called a total war, one on which the Union expended money and manpower at unprecedented levels. Confederate strategists hoped to break the will of the northern homefront to secure southern independence. Despite the hardships endured in the North, this strategy failed. On the homefront, women struggled to provide for their families as well as to serve soldiers and the army by sending care packages and doing war work. Family letters reveal the impact of the war on children who lost their fathers either temporarily or permanently. Communities rallied to aid soldiers’ families but were riven by dissension over issues such as conscription and emancipation. Immigrants and African Americans sought a new place in U.S. society by exploiting the opportunities the war offered to prove their worth. Service in the Union army certainly advanced the status of some groups, but was not the only means to that end. Nuns who nursed the wounded improved the reputation of the Catholic Church and northern African Americans used the increasingly emancipationist war goals to improve their legal status in the North. The Civil War altered race relations most radically, but change came to everyone on the northern homefront.

The Posse Comitatus Doctrine in Early America

Courts and legislatures in colonial America and the early American republic developed and refined a power to compel civilians to assist peace and law enforcement officers in arresting wrongdoers, keeping the peace, and other matters of law enforcement. This power to command civilian cooperation was known as the posse comitatus or “power of the county.” Rooted in early modern English countryside law enforcement, the posse comitatus became an important police institution in 18th- and 19th-century America. The posse comitatus was typically composed of able-bodied white male civilians who were temporarily deputized to aid a sheriff or constable. But if this “power of the county” was insufficient, law enforcement officers were often authorized to call on the military to serve as the posse comitatus. The posse comitatus proved particularly important in buttressing slavery in the American South. Slaveholders pushed for and especially benefited from laws that required citizens to assist in the recapture of local runaway slaves and fugitive slaves who crossed into states without slavery. Though slave patrols were rooted in the posse comitatus, the posse comitatus originated as a compulsory and noncompensated institution. Slaveholders in the American South later added financial incentives for those who acted in the place of a posse to recapture slaves on the run from their owners. The widespread use of the posse comitatus in southern slave law became part of the national discussion about slavery during the early American republic as national lawmakers contemplated how to deal with the problem of fugitive slaves who fled to free states. This dialogue culminated with the Fugitive Slave Law of 1850, in which the US Congress authorized officials to “summon and call to their aid the bystanders, or posse comitatus” and declared that “all good citizens are hereby commanded to aid and assist in the prompt and efficient execution of this law, whenever their services may be required.” During Reconstruction, the Radical Republican Congress used the posse comitatus to enforce laws that targeted conquered Confederates. After the end of Reconstruction in 1877, Southern states pushed Congress to create what would come to be known as the “Posse Comitatus Act,” which prohibited the use of federal military forces for law enforcement. The history of the posse comitatus in early America is thus best understood as a story about and an example of the centralization of government authority and its ramifications.
