Treaty Law: New Trends

Treaties are agreements between sovereign states, and occasionally between states and international organizations. Treaties can include conventions, covenants, charters, and statutes, all of which are legally binding under international law. There are two main types of treaties: bilateral and multilateral. Bilateral agreements are concluded by a limited number of states (usually two), and typically address a narrow set of issues that are unique to specific parties and particular circumstances. Multilateral treaties, on the other hand, establish generalized principles of conduct that apply to a wide range of states without regard to the future particularistic interests of the parties or the strategic exigencies that may exist in a particular occurrence. Treaties can serve a wide variety of functions: ending wars and establishing conditions for peace; creating new international organizations or alliances; generating new rules of coexistence and cooperation; regulating a particular type of behavior; distributing resources; and initiating new rights and obligations for future relations. No single organization or agency has the authority to enforce treaty commitment. Rather, treaties can be enforced in at least two ways. First, states can use diplomatic, economic, and/or military coercion. Second, some treaties establish their own enforcement mechanisms; for example Chapter VII of the United Nations Charter grants enforcement authority to the Security Council.


Trust and International Organization

Trust is the expectation that one’s interests be looked after despite the possibility of exploitation by the one being trusted (trustee). Trusting always involves some risk on the part of the one trusting (truster). The truster is vulnerable—either by choice or by circumstance. One can never be absolutely sure that one’s interests are important to the trustee or that their past performance can allow one to predict future behavior. The trustee retains their agency and even has an incentive for betrayal in the future. Much of the research on trust in international relations is aimed at explaining cooperation amid anarchy. In this context, cooperation begins with a leap of faith by actors who trust generally rather than specifically. Such “generalized trusters” do not require evidence that the trustee in question is even trustworthy with respect to a particular issue, because all actors are assumed to be worthy of trust across all topics (assuming they have the capacity to act). This can be considered “credulity,” and it primarily involves having trustful attitudes, affects, emotions, or motivational structures that are not focused on specific people, institutions, or groups. Furthermore, one cannot speak of trust without some reference to affect, particularly because one can never absolutely calculate the odds of betrayal.


Twenty-First Century Developments in the Field of Science, Technology, and International Relations

Traditionally, international relations (IR) conceptualized technology primarily as a static, neutral, and passive tool, which emanates from impenetrable black boxes outside the international system. According to this predominant instrumental understanding of technology, IR “added” technology as a residual variable to existing explanatory frameworks. Consequently, qualitative systemic change—as well as continuity—could only be addressed within existing models and their respective core variables. Subsequently, traditional approaches increasingly experienced difficulties to adequately capture and explain empirically observable systemic changes in the form of growing interdependence, globalization, or trans-nationalization, as well as a plethora of technology-induced new policy challenges. Contrary to traditional conceptualizations, a growing number of scholars have instead embarked on a project to open the “black box” by redefining technology as a highly political and integral core component of global affairs that shapes and itself is shaped by global economics, politics, and culture. A rapidly growing body of theoretically diverse interdisciplinary literature systematically incorporates insights from science and technology studies (STS) to provide a more nuanced understanding of how technology, the global system, and its myriad actors mutually constitute and impact one another.


UN, Gender, and Women

After the end of World War II, women’s rights advocates at the United Nations vigorously campaigned for equality between the sexes. At the UN Charter Conference held in San Francisco in 1945, women delegates fought for the recognition of sex-based discrimination as a violation of human rights in Article 1 of the Charter. At the UN, issues relating to women were primarily placed under the purview of the Commission on the Status of Women (CSW), established in June 1946 with the mandate to “prepare recommendations and report to the Economic and Social Council on promoting women’s rights in political, economic, civil, social and educational fields.” Three main perspectives underpin feminist International Relations (IR) literature on the UN, gender and women: promoting women’s participation and inclusion of women’s issues at the UN; gender critique of the UN, geared towards institutional transformation; and challenging the universality of the UN. Despite some fundamental differences between these three strands of thinking, their political significance is widely acknowledged in the literature. The co-existence of these contentious viewpoints resonates with the vibrant feminist politics at the UN, and offers a fruitful avenue for envisioning a better intergovernmental organization. This is particularly relevant in light of feminist scholars’ engagement with activism and policymaking at the UN from the very beginning. Nevertheless, there are issues that deserve further consideration, such as the workings of the UN, as reflected in its unique diplomatic characteristics and bureaucratic practices.


United Nations Peacekeeping and Civil Conflict

UN peacekeeping serves as the foremost international tool for conflict intervention and peace management. Since the Cold War, these efforts have almost exclusively targeted conflicts within, rather than between, states. Where traditional peacekeeping missions sought to separate combatants and monitor peace processes across state borders, modern peacekeeping in civil wars involves a range of tasks from intervening directly in active conflicts to rebuilding political institutions and societies after the fighting ends. To accommodate this substantial change, peacekeeping operations have grown in number, size, and scope of mandate. The increasing presence and changing nature of peacekeeping has sparked great interest in understanding when and how peacekeeping is used and how effective it is in delivering and sustaining peace. Significant advances in peacekeeping data collection have allowed for a more rigorous investigation of the phenomenon, including differentiation in the objectives, tasks, and structure of a mission as well as disaggregation of the activities and impact of peacekeepers’ presence across time and space. Researchers are particularly interested in understanding the adaption of peacekeeping to the unique challenges of the civil war setting, such as intervention in active conflicts, the greater involvement and victimization of civilians, the reintegration of rebel fighters into society, and the establishment of durable political, economic, and social institutions after the fighting ends. Additional inquiries consider why the UN deploys peacekeeping to some wars and not others, how and why operations differ from one another, and how the presence of and variation across missions impacts conflict countries before and after the fighting has stopped.


The United States and International Environmental Politics

Environmental politics refers to the examination of the environmental stances of both mainstream political parties and environmental social movements. It also includes the analysis of public policymaking and implementation affecting the environment, at multiple geo-political levels. In most cases, the United States is the most important country involved in international environmental politics, being the world’s largest consumer and polluter of natural resources. For instance, the United States surpasses any other countries in the emission of greenhouse gases (GHGs), except China. With less than one-twentieth of the world’s population, the United States produces nearly one-fourth of the world’s GHGs. However, by diminishing its emissions of such pollutants, the United States could have an immensely disproportionate positive impact on international environmental problems. Having the world’s largest economy, the United States has considerable financial resources that can be directed at environmental problems internationally, and its technological advancement has great potential in this regard. The United States can either boost or delay multinational negotiation of agreements, thereby influencing whether there will be effective environmental protection on the ground throughout the world. It is important to note the significance of studying the role of the United States in international environmental politics in order to better understand the major issues exercising US policy, and to reveal that the forces shaping US environmental foreign policies are complex and disparate.


United States Intelligence Cultures

Organizational culture refers to the constellation of values, beliefs, identities, and artifacts that both shape and emerge from the interactions among the formal members of the US intelligence community. It is useful for understanding interagency cooperation and information sharing, institutional reform, leadership, intelligence failure, intelligence analysis, decision making, and intelligence theory. Organizational culture is also important in understanding the dynamics of US intelligence. There are four “levels” of, or “perspectives” on, organizational culture: vernacular and mundane organizational communication; strategic and reflective discourse; theoretical discourse; and metatheoretical discourse. Meanwhile, four overarching claims can be made about the intelligence studies literature in relation to organizational culture. First, explicit references to organizational culture within the literature do not appear until the 1970s. Second, studies of organizational culture usually critique “differentiation” among the subcultures of a single agency—most often the CIA or the FBI. Third, few intelligence scholars have provided audiences with opportunities to hear the voices of the men and women working inside these agencies. Finally, the majority of this literature views organizational culture from the dominant, managerial perspective. Ultimately, this literature evidences four themes that map to traditionally functionalist assumptions about organizational culture: (1) a differentiated or fragmented culture diminishes organizational effectiveness, while (2) an integrated or unified culture promotes effectiveness; (3) senior officials can and should determine organizational culture; and (4) the US intelligence community should model its culture after those found in private sector corporations or institutions such as law or medicine.


Universals and Particulars in International Relations Theory

One of the most vigorous debates within the discipline of international relations (IR) revolves around the “universal/particular” dichotomy: the tensions between worldviews that emphasize the “whole” as a unified entity or set of ideas—in the case of IR, the “whole” typically refers to the “whole world”—and those that emphasize constituent “parts”, and the differences among them. Discussions regarding universalism and particularism have involved the traditions of realism, liberalism, and the English School, as well as critical theory, poststructuralism, and postcolonialism. Furthermore, the opposition between universalism and particularism has often taken the form of the analysis of conflict between the sovereign state, on one hand, and universal human rights, on the other. Feminists have been particularly influential in challenging the universal/particular debate in the context of human rights. Their perspectives on human rights are exemplary of feminist scholarship in the field of international ethics more generally. Indeed, feminists are constantly striving to mitigate and overcome the tensions between the universal and the particular through their commitment to relationality. The crucial question that remains is: What should be the relationship between the universal and the particular and how should we conceive of this relationship in a non-antagonistic and constructive manner? The answer lies in conceiving the relationship between the two as a dialectical one. In order to understand the universal, it is important to accept the fact that it is derived from particular local contexts and can only be realized through the culturally specific norms and rules in each context.


Using Facebook as an Educational Resource in the Classroom

Facebook is a social networking site created in 2004 which has since obtained over a billion users, and it has the potential to facilitate learning in the classroom. With the widespread use of Facebook in society, it simply makes sense to look into ways it might be used in higher education. In fact, a number of studies have been done by scholars in different disciplines regarding the use of Facebook (in general and in academia). These include studies by scholars in library science, education, media and communication, psychology, management information systems, business, political science, marketing, instructional technology, and commerce and accounting. Students come to school wired and are willing and eager to use technology, but higher education has a well-established trend toward non-adoption of new technologies. A variety of studies on the use of Facebook, however, indicate that there are a wide number of potential benefits to using Facebook as an educational tool. There are four inter-related potential benefits: creating a sense of community and promoting collaboration, enhancing communication between instructors and students, developing computer literacy and language skills, and incorporating current student culture into the learning environment. In addition, Facebook is particularly well suited for sharing and discussion of current events in the news.


Using Geography to Rethink the State

The state can be viewed as a form of community. Forms of human community and their attendant territorialities have been characterized by extreme variation, both historically and geographically. A profound territorial link exists between the state and the nation, with the former claiming to be a sovereign expression of the nation. A common feature of states is that they all have territorial boundaries. Moreover, the state can be interpreted as a territorial–bureaucratic expression of nationalism, found in many public rituals such as coronations and remembrance days, military parades, national holidays, swearing in of governments, and state funerals. One of the most contentious issues among states, potential states, and nations revolves around sovereignty. Challenges to sovereignty and the historical and geographical complexity of nations may be seen in terms of political landscapes as “sovereigntyscapes.” Related to the question of sovereignty are the so-called “shadow powers and networks” that transcend territorial boundaries. In the field of political geography, in tandem with significant strands of International Relations and Political Science, state power is recognized as a key, albeit not the only form, of territorial politics. The state’s relationship with the ideas of nation and citizen give rise to a host of particularisms, similarities, and contradictions that require theoretically informed yet thoroughly grounded research in divergent contexts.


Using Online Engagement Activities in International Studies Courses

Although instructors are increasingly adopting the practices of online engagement in the field of international studies, there are few discussions in the disciplinary literature of its methods, advantages and disadvantages. Online engagement can be considered as a type of class participation that takes place on the Internet. It refers to engagement between groups of students and an instructor, as well as engagement among students. Online engagement activities can be integrated into fully-online courses, or they may supplement in-class participation in traditional courses., There are five common methods that can be used to create online engagement among students: online discussion boards, class blogs, social networking sites such as Twitter and Facebook, wikis, and online simulations. Each of these has its advantages and disadvantages. For each there are case studies in the literature, and best practices can be summarized. Online engagement should not be technology-driven; rather, it should be integrated with the course content and learning outcomes. Instructors should craft assignments in ways that encourage creative and critical thinking, and should take into account the particular problems that arise in the absence of face-to-face interaction. Online engagement activities should be chosen to mitigate some of the issues with traditional classroom activities, and/or develop novel skills that are relevant to the 21st-century economy. These activities should be accessible to all—including, but not restricted to, students with disabilities. Instructors and institutions should also be aware of ethical and legal issues, such as privacy, and the ownership of the data generated by online engagement activities by users.


Utilitarianism and International Ethics

Utilitarianism is inextricably linked to international ethics. The roots of the principle of utility can be traced to the 18th and 19th centuries, when it was employed by thinkers such as David Hume. However, Jeremy Bentham first formulated utilitarianism in detail and carefully studied its implications. According to Bentham, happiness is a condition in which an individual enjoys more pleasure than pain. Because utilitarianism is focused on the welfare of the individual, state boundaries are of little consequence. Its reach is inherently global. There are different varieties of utilitarianism. What sets them apart from other ethical theories is their stipulation that whatever is of value should be maximized for all and whatever of disvalue should be minimized for all. For Bentham, pleasure is the ultimate value. Later, John Stuart Mill distinguished between higher and lower pleasures and argued that higher pleasures should be given greater weight. In the 20th century, authors such as R. M. Hare determined that maximal satisfaction of preferences is the value to be sought. The utilitarian emphasis on maximization of value and its choice of values have generated much criticism from those who espoused human rights theories, such as John Rawls and those influenced by his work. At present, the scholarly literature dealing with issues related to international ethics mostly comes from those who are committed to human rights theory or who are committed to equality of outcomes for human beings.


Virtue Ethics and International Relations

Virtue Ethics (VE) is a way of thinking about how to behave well which focuses on the character of moral agents and the nature of the good life. This contrasts with dominant approaches to international ethics which prioritize the identification or development of moral rules or duties (deontological approaches) or the consequences of actions (consequentialist approaches). The relevance of virtue ethics to international affairs is established by setting out the critique of the dominant law-based approaches offered by VE and then exploring the positive contribution VE can make. Virtue ethicists argue that character and a concrete conception of the human good are central to ethics—that the right question to ask when working out what it means to be ethical is not “what should I do” but “what sort of person should I be?” The three central concepts in VE—virtue, practical wisdom, and flourishing—have not been applied systematically qua VE in international political theory or international relations, but their appearance in various guises in recent scholarship suggests avenues for future research. Four such avenues are identified, ranging from the moderate to the radical, which offer innovative ways to confront key ethical dilemmas faced in international affairs.


Visual Methodologies: Theorizing Disasters and International Relations

There is an increase in extreme weather conditions due to human-induced climate change. Their impacts are most severely felt by the marginalized and the poor in the Global South. Increasingly, study of international relations focuses on the varied forms of disasters and the global politics that emerge around them. Disaster studies scholarship actively challenges the myth of existence of “natural disasters.” Instead of defining them as being “natural,” disasters are conceived as serious disruptions to the functioning of a community or a society with human, material, economic, or environmental losses. The disaster concept is thus separated, first, from hazards such as earthquakes, cyclones, and floods, and “disaters” are not limited to events resulting from natural hazards. Disasters emerge also as a result of major economic and political instabilities due to the nature of the contemporary global political economy and global financial crises. Disasters also include those that often go unnoticed such as violent conflicts or famines, and also include global pandemics such as Ebola and COVID-19. Disasters understood in this way also include aftermaths of resource extractivism and settler coloniality. The intersection of disasters and visual methodologies offers insights into theorizing International Relations nature, the everyday, and the politics of disasters. This article focuses on such visual and audiovisual scholarship that has predominantly emerged from, and actively engages with, collaborative visual methodologies and a rethinking of research processes. Such works offer insights into critical exploration of academic knowledge production processes and praxis, suggesting that visual is not a method, but a methodological and ethical choice. Research processes adopting photo-elicitation, graphic novels and comics, and films in specific disaster contexts challenge text-dominated scholarship and offer reflection on the roles between the researcher and researched, and on the question of authorship. Turning to visuals also brings to the fore questions of representations and the strategic use of the visual in the overall scholarly storytelling practice. Further, scholars have suggested that instead of focusing on the visual devices, or the visual products, visual methodologies as a process orientation allow questions related to democratizing and accessibility to the research process to be addressed, weighing up whose priorities matter, that is, making research useful for (Indigenous) communities and resisting legacies of the imperial shutter.


War, Conflict, and Human Rights

The relationship between human rights and armed conflict is rooted in historical debates among religious, philosophical, and international legal scholars about the nature of a just war, and appropriate conduct in war, which also have come to underpin and international humanitarian law. An understanding of the links between human rights, war, and conflict can begin with conflict analysis, as human rights violations can be both cause and consequence of conflict. In the most general sense, grievances over the denial or perceived denial of rights can generate social conflict. This may be the case where there is systematic discrimination based upon race, ethnicity, caste, religion, language, gender, or other characteristics. Alternatively, human rights abuses can emerge as a result of violent conflict. A conflict may have been undertaken by the parties primarily out of concern to promote a political or ideological agenda, or to promote the welfare of one or more identity group(s), or over access to resources. Human rights are also potentially transformative of conflicts and may make their resolution a greater challenge. Thus, conflicts that begin as conflicts over resources, religion, or ethnic or territorial claims, may, as they progress, create new grievances through the real and perceived violation of human rights by one or more parties to the conflict.


Wars for Ethnic or Nationalist Supremacy

Conflicts that occur along ethnic or nationalist lines are often the most protracted, violent, and difficult to resolve in the long term. Civil wars are often divided into two distinct types: ethnic/religious wars (identity), and revolutionary wars (nonidentity). The distinction between these conflict types is based on whether cleavages within a society occur along ethnic lines or along lines that cut across ethnic divisions and are focused on issues including class, ideology, or seeking significant policy orientation of change. The most significant theoretical and empirical contributions to the understanding of ethnic conflicts in recent years come from the disaggregation of civil wars focusing on micro- and group-level dynamics. This disaggregation supports theoretical advancement and a departure from using macro-level data with micro-level mechanisms supports transition from a monadic to dyadic study of ethnic conflict, and supports examination of potential causal mechanisms of ethnic violence. Scholarly traditions and theoretical approaches explaining identity mobilization along ethnic or nationalist lines, the contributing factors that explain the transition from mobilization to the exercise of political violence, the duration of identity-based conflicts, and the long-term prospects for settlement of the conflict have enjoyed a proliferation of studies using newly available data featuring subnational units. These include explanations of conflicts based in sociological foundations focused on the formation and maintenance of identity, structural explanations for internal conflict focus on the capacity of the state and the distribution of political authority within a political system, and the opportunity for rebellion.


War Termination

War termination can be defined as the tacit or formal agreement and implementation of decisions to cease fighting on the battlefield. In older literature, scholars focused on the roles of the “winner” and the “loser,” and the endogeneity of the belligerents’ war aims. One group argues that war ends when the “loser” recognizes his position and accedes to the “winner’s” demands. A second group argues that war ends when the combatants agree to a settlement which both prefer over continued fighting. In other words, war is seen as a form of bargaining, where states make rational cost–benefit calculations about war and its termination. These scholars by and large contend that the belligerents’ war aims fluctuate during war, and that the terms of settlement may be very different from the combatants’ original aims. Few studies have highlighted the role of domestic politics. Central in this research is the recognition that the outcome of war and the terms of settlement will affect the domestic political balance of power, and will leave some groups and individuals as domestic political “losers” and others as “winners.” Ikle (1971), for example, argued that the question whether and on what terms to end a war will be particularly difficult to decide for the government that is losing the war. “Hawks”— those who want better terms and favor a continuation of the war—will face off against “Doves,” who would prefer to end the war and are willing to grant more generous terms.


Wartime Sexual Violence

Sexual violence perpetrated during war—for instance, in Ukraine, the Central African Republic, the Democratic Republic of Congo, Bosnia, or Rwanda—has attracted a large amount of media, political, and academic attention. It has also been the object of numerous national and international policy initiatives like United Nations Security Council Resolutions, and it has given birth to an abundant empirical and theoretical literature. While more information on the causes, actors, frequency, and patterns of wartime sexual violence has been gathered, a number of issues have remained under-researched, such as how wartime sexual violence affects cisgendered men and boys, as well as sexual and gender minorities. Reviewed are existing theoretical approaches to wartime sexual violence, dividing these approaches into two partly overlapping and complementary categories. The first focuses on the cultural environment in which sexual violence is perpetrated, and in particular on gender roles, norms, and relations that underpin it, while the second focuses on perpetrators, and discusses their strategic or opportunistic motives. Both theoretical strands tend to focus primarily on wartime rape against women, somehow paying less attention to other forms of conflict-related sexual violence, and to other categories of victims. This article critically reviews the questions that these theoretical strands have left pending, with particular emphasis on five debates: First, how exactly does wartime sexual violence relate to other forms of violence committed during conflicts and/or in “peace times”? Second, how can sense be made of the complex causality entailed in the perpetration of wartime sexual violence? Third, how will incorporating non-female, as well as non-cisgendered female victims, change our views and theories of wartime sexual violence? Fourth, can these accounts be incorporated and, if they can, how can the prevalence of wartime sexual violence and its variations be effectively measured? And fifth, how can researchers ensure that research results are usable for policy purposes? In order to provide answers to these questions, and to move the analysis forward, research should question the binary readings that lie at the core of the study of wartime sexual violence (notably the male/female and peace/war binaries), and systematically challenge the way victims, perpetrators, and types of sexual violence have been framed so far. This article also foregrounds the suggestion to adopt an intersectional analysis in the study of wartime sexual violence, to better understand the relations between its perpetration and broader societal cleavages. Such analyses would aid, at the policy level, the development of more efficient prevention strategies and support programs for survivors.


What is Development?

Development was born as aid, an expression of the modern obsession with “caring” used by disabling professions and the service industry. However, by 1980, it was already clear that there was no correlation between aid and economic growth, and that aid was an obstacle for social transformation. Development was also born in the context of the Cold War. For President Truman, the American way of life was a democratic and egalitarian ideal to overcome the communist “threat” by closing the gap between industrial and “underdeveloped” countries. In addition, development was a reaction to the initiatives of the colonized world, increasingly challenging Western domination. Since Truman, development has connoted at least one thing: to escape from the vague, indefinable, and undignified condition known as underdevelopment. However, the Age of Development—the historical period formally inaugurated in 1949—is now coming to an end. The future of development studies lies in archaeology, to explore the ruins it left behind by looking at development’s pre-history and conceptual history, as well as the development enterprise. Since the 1970s, new campaigns were launched to focus the effort in getting for the underdeveloped, at least, the fulfillment of their “basic needs.” Meanwhile, the “law of scarcity” was construed by the economists to denote the technical assumption that man’s wants are huge and infinite, whereas his means are limited though improvable. Poverty and development thus go hand in hand. Indeed, historical experience reveals that development generates poverty. By 1985, the idea of post-development has already emerged.


What is Theory?

The concept of theory takes part in a conceptual network occupied by some of the most common subjects of European Enlightenment, such as “science” and “reason.” Generally speaking, a theory is a rational type of abstract or generalizing thinking, or the results of such thinking. Theories drive the exercise of finding facts rather than of reaching goals. To formulate a theory, or to “theorize,” is to assert something of a privileged epistemic status, manifested in the traditional scholarly hierarchy between theorists and those who merely labor among the empirical weeds. In so doing, a theory provides a fixed point upon which analysis can be founded and action can be performed. Scholar and author Kenneth W. Thompson describes a nexus of relations between and among three different senses of the word “theory:” normative theory, a “general theory of politics,” and the set of assumptions on the basis of which a given actor is acting. These three types of theory are somehow paralleled by Marysia Zalewski’s triad of theory as “tool,” theory as “critique,” and theory as “everyday practice.” While Thompson’s and Zalewski’s interpretations of theory are each inherently consistent, both signal a different philosophical ontology. Thompson’s viewpoint is dualist, presuming the existence of a mind-independent world to which knowledge refers; while Zalewski’s is more of a monist, rejecting the mind/world dichotomy in favor of a more complex interrelationship between observers and their objects of study.
