The development of LGBT movements and interest groups in Eastern Europe and the former Soviet Union reflects the region’s unique political development with respect to the experience of communism, the transition to democracy in the 1990s, the expanding influence of international institutions like the European Union (EU), and, most recently, trends of democratic backsliding and even reversion to outright authoritarian rule in some countries. Each of these aspects of the region’s political development has engendered debate among scholars and activists. There is consensus that the experience of communism strongly circumscribed not only the possibilities for activism but also, in some instances, even the possibilities for articulating LGBT identities. Nevertheless, a survey of the scholarship on postcommunist LGBT politics indicates divergent trajectories between countries of the former Soviet Union, where LGBT identities are less established and activism is less organized, and the former satellite states of Eastern Europe, whose experience under communism was shorter and, arguably, less intense. Without ignoring the evident deficits of Eastern Europe’s LGBT activism in the 1990s, its LGBT people benefited relative to counterparts in the former Soviet Union from a generally more successful transition to democracy and a greater degree of exposure to West European institutions, in particular the EU. The process of applying for EU membership, many scholars argue, advantaged these countries’ LGBT movements vis-à-vis their counterparts in the former Soviet Union by pressuring national governments to be more accommodating and by socializing elites and publics to Western Europe’s comparatively tolerant values and LGBT rights norms. Adjusting to these norms was sometimes contentious, but several scholars argue that, where conservative backlash against LGBT rights occurred during the EU’s first round of expansion in 2004 to 2007, it generally helped domestic activism by increasing its visibility and level of organization.
Not all are so optimistic about the EU’s impact on LGBT activism, however, particularly those studying Yugoslavia’s successor states, for whom the EU accession process occurred later or is still ongoing. These scholars emphasize the difficulties of squaring EU norms about LGBT rights with national identity, particularly given the EU’s sometimes colonial-like relations with postcommunist societies. Others note that transnational rights advocacy supported by the EU has been matched by the rise of transnational antigay activism, and that the clash of transnational activism stalemates domestic progress on LGBT-friendly policies. Such critiques appear increasingly relevant as trends of democratic backsliding have emerged since the 2010 world financial crisis in former “success cases” of postcommunist transition and EU integration, notably Hungary and Poland. The latter’s democratic backsliding occurs within the larger context of Russia’s reversion to authoritarianism after the brief political opening of the 1990s. Across these three countries, governing elites have shown a readiness to make use of LGBT issues to define their illiberal ideologies and to mobilize voters. Whether these developments portend a narrowing of differences among LGBT movements in the former Soviet Union and Eastern Europe is a key question for future scholars.

What’s a “Norm” After Queer Movements?

The question of “norm” is central to queer theory. As this reading of Judith Butler’s Gender Trouble (1990), regarded as one of the pioneering texts in queer theory, shows, queer theory has consistently discussed the actual power of the norm, how it works, and how it is appropriate for minority movements to position themselves in relation to norms to abolish them. As many writings and discussions on this subject suggest, the reflection on the norm is based on an internal feminist discussion of identity. Just as there is no naturalness of sex, there is also no natural, preexisting identity. Denaturalizing identity by asserting that identities do not preexist when they are invoked calls for strategic use of identity while at the same time conducting a critique of how identities are produced.
More fundamentally, the discussion of norms is linked to a reflection on “priority.” By asserting that there is no being or ontology that precedes socialization and the application of social norms, Butler denies any relevance to the project of reconnecting with practices and identities that have not been shaped by these norms and are thus considered free, escaping power.
Postulating that there is no state prior to law, norm, and power calls for strategies of resistance and subversion. There is a need to place oneself within the normative devices and structures produced by power to subvert them. The notion of “performativity” condenses this conclusion by describing the possibility of producing acts that, within the normative system, displace normative meanings. Resistance and subversion lie in the parodic game, in the displacement of gender norms within the structure that produces them.
The assertion that “there is no political position purified of power, and perhaps that impurity is what produces agency as the potential interruption and reversal of regulatory regimes” leads to a radical redefinition of politics. All subversive politics thus remain dependent on prevailing norms and structures, within which it acts to contest them. Subversion can only ever be local and never total, as much temporally as geographically. It can only intervene in a place, at a given moment, with reference to a given normative apparatus. Insofar as it remains necessary always to draw on a norm in order to challenge and resignify it, it will never be possible to contest all social norms definitively; it will only be possible to weaken certain ones from time to time. It then remains to identify, at some point, the power with which one wishes to fight, and the most effective strategies to weaken it.

Homosexuality Under Socialism in the German Democratic Republic

In general, the German Democratic Republic (GDR) did not treat its gay and lesbian citizens very favorably. Although the legal situation was more liberal than in the Federal Republic (West Germany) and other Western European countries, most homosexual East Germans lived in a state of invisibility at best, or suffered direct homophobia at worst, often at the hands of the government. In the mid-1980s, the public and government stance toward homosexuality liberalized slightly, leading to small improvements in the lives of gay East Germans. However, gay East Germans never experienced many of the same freedoms or opportunities that their West German, other Western European, or American counterparts enjoyed.
Gay East Germans occupied a difficult position within the socialist ideology of the GDR. In theory, each East German was equal, enjoying universal rights and opportunities, and living free from discrimination. At the same time, however, the smallest building block of the society was the heterosexual, reproductive, married couple: a model into which same-sex desiring people could not fit. This doctrine of supposed equality probably contributed to the fact that homosexuality was decriminalized earlier in the GDR than in the Federal Republic, but it was also used by the SED (Sozialistische Einheitspartei Deutschlands: the ruling, dictatorial party) as an excuse not to engage further with the specific needs of gay citizens until the mid-1980s.
The GDR saw some limited gay activism in the 1970s in the form of the Homosexuelle Interessengemeinschaft Berlin (HIB); however, the group’s activities never really extended outside of East Berlin and did not lead to significant political or social change. More impactful activism occurred in the 1980s under the aegis of the Protestant Church as the only organization in the GDR that operated largely outside of state control. The SED eventually yielded to some of the demands of gay activists—by sanctioning publications and meeting spaces, for example—but did so primarily to draw gay activists out of the protection of Church structures and in order to be able to monitor and control them more easily.
There are few East German literary or artistic works that engage with homosexuality, although a number of relevant literary works were published in the 1980s. These contributed to a fledgling discourse around homosexuality, shifting the issue from a taboo topic to one more acceptable for discussion in the public sphere. However, when East German audiences viewed Heiner Carow’s Coming Out in 1989—the first and only East German feature film to depict homosexual relationships—many claimed that it was their first exposure to homosexuality. And, since the GDR ceased to exist as a state fairly abruptly in 1990, one will never know how the trajectory of gay rights activism may have continued.

Political Recruitment and Candidate Selection in Latin America

Candidate recruitment and selection is a complex and opaque process that drives political outcomes and processes. Further, the process of candidate selection is notoriously difficult to study because of its informal nature, the multiplicity of actors involved, and because politicians may prefer to obfuscate their motives when asked about their decisions. Still, the literature has made advances in understanding recruitment and selection (R&S) and this article explores this crucial and understudied topic with respect to Latin America.
Much literature has considered the importance of political institutions to candidate selection, but these explanations alone are insufficient. Analyses of political institutions have significantly advanced in the region, but in isolation, their explanatory power can fall short, as evident in examples where similar institutional frameworks yield different outcomes . This suggests the need to include informal processes when analyzing candidate recruitment and selection procedures. Then, armed with a more complete understanding of the processes, we can better assess the impacts of candidate choice on political outcomes.
There is extensive work on recruitment and candidate selection in Latin America that focuses on executives, legislators, and gender. Each of these themes provides multiple examples of how outcomes are determined through a combination of formal institutions and informal practices. .
The region’s politics have been trending towards more formal, open, and inclusive processes. This is largely a result of the belief that there is a crisis of representation for which parties are to blame. Reformists have thus championed more inclusive selection processes as an antidote to the problem of low-quality representation. By themselves, however, these reforms are insufficient to enhance the quality of democracy and they can have high associated costs for the democratic system. Therefore, the multiple consequences of the R&S process—intended and hidden—should raise caution for scholars and reformers.

Attitudes Toward LGBT People and Their Rights in Europe

Attitudes toward LGBT people have changed in Europe since the 1990s; there is generally much more tolerance and acceptance. Evidence drawn from surveys and research projects including the European Social Survey, European Values Study, and Pew Research Center illustrate the types of attitudes that have changed, and in which European countries change has occurred. A comparison of attitudes and tolerance across Europe indicates that some countries and groups of countries are more accepting of LGBT people. North-western European nations appear high in the tolerance rankings of trend surveys, while more easterly European nations have not always followed this progression. Indeed, in cases such as Russia and Chechnya, “propaganda laws” have denied LGBT people basic human rights. Hostility toward and violence against LGBT people is perpetrated with seeming impunity in these areas. Factors that influence attitudes toward LGBT people and their rights include democracy and economic development, religiosity, global forces, and degrees of contact.
There is a clear link between legislation and attitudes; in countries where legislation is in place and, for example, where same-sex marriage is legal, surveys overwhelmingly show a higher acceptance of LGBT people. Legislation is a powerful influence in shaping social attitudes, so it is important to consider the legislation adopted by various European countries. Institutions such as the European Union are effective in providing protections for LGBT citizens as well as leading on areas such as the Common European Asylum System (CEAS). There has been “pushback” in terms of change and one of the more contested areas is same-sex marriage. While the trend since the late 20th century has seemed to be toward introducing same-sex marriage, a number of countries, largely in Eastern Europe, have introduced constitutional bans on same-sex marriage, defining marriage as solely between a man and woman. The position of trans and non-binary people is particularly perilous since there is very little legislative protection in place for them. There has been a positive change in attitudes and legislation across Europe which has enhanced the lived lives of LGBT people; these changes, however, have not been even or uniform across the area.

Citizenship of the European Union

Citizenship is usually conceptualized as a unitary and exclusive relationship between an individual and a sovereign state; yet the European Union (EU) has developed the most advanced form of contemporary supranational citizenship. Citizenship of the European Union guarantees EU citizens and most members of their families the right to move, live, and work across the territory of the EU. It also guarantees the right to vote in local and European elections in the member state of residence, the right to consular protection outside the EU when the member state of nationality is not represented, the right to access documents or petition Parliament or the Ombudsman in any of the official languages, and the right to be treated free from nationality-based discrimination. Though on the political agenda since the postwar origins of European integration, EU citizenship was not formalized into EU law until the Maastricht Treaty. Since then, the Court of Justice of the European Union (CJEU) has declared that “EU Citizenship is destined to be the fundamental status of nationals of the Member States” and there are ongoing discussions about the relationship between EU and member state citizenship. In terms of identity, increasing numbers of Europeans see themselves as citizens of the EU, and questions of citizenship are at the heart of debates about the nature of European integration.

Elections and the Role of LGBT Issues in the United States and Abroad

LGBT issues have played an important role in elections. They have been the focus of direct democracy, that is referenda and ballot initiatives in which citizens voted on LGBT rights. The issues considered evolved over time from nondiscrimination ordinances in the 1970s to same-sex marriage bans in the 2000s and transgender rights in the 2010s. Religiosity, partisanship, and ideology generally predicted electoral outcomes. While supporters of LGBT rights have often been defeated at the ballot box, the tide started to change in the 2010s. Beyond direct democracy, LGBT issues have played a role in general elections. The religious right exploited them to mobilize the conservative electorate or to persuade voters to reconsider their party loyalties. The 2004 US presidential election, when same-sex marriage bans were on the ballot in several states, offers an important case study. LGBT actors are also important in elections. LGB voters have generally been more progressive and more supportive of the Democratic Party than the general population. Additionally, the number of openly LGBT candidates has significantly grown over time. In the early years, gays and lesbians running for office faced an electoral penalty but made up for their disadvantage by strategically competing in more favorable districts. By the late 2010s, however, large subsets of the electorate, including Democrats, progressives, nonreligious voters, and people with LGBT friends no longer penalized gay and lesbian candidates. The penalty remained stronger for transgender candidates. LGBT issues have also been important outside the United States, as shown by same-sex marriage referenda in Europe and beyond and by the increasing success of lesbian and gay candidates in the United Kingdom and New Zealand. Future research should explore issues concerning minorities in the LGBT community, the shifting position of right-wing parties on LGBT rights, and the role of LGBT issues and candidates in elections outside the Western world.

The European Union’s International Promotion of LGBTI Rights in its Foreign Relations

Despite ongoing challenges, the European Union (EU) not only is a major actor on the world stage, but also emphasizes human rights for LGBTI individuals in its internal and external policies, thus setting a powerful example for acceptance and inclusion worldwide. While this establishes the EU as a presumptive normative actor from a liberal human rights perspective, a number of disputes over those rights policies and the way they are promoted have emerged in bilateral relations between the EU and other states in recent years. Given Europe’s colonial history, the fact that the bloc is collectively the world’s largest provider of development assistance, and the volatility of LGBTI human rights defenders, it is important to investigate how the EU and its member states promote LGBTI rights internationally. The EU institutions attempt to jointly formulate and implement guidelines for the external promotion of such rights, though no uniform rights standards exist across the various member states.
The compatibility of EU and member states’ conceptions of LGBTI rights and the more general question of how far the EU is, can, or should be a “normative” agenda-setting power on the world stage are central. This heavily contested but also popular ideational concept glosses over the limited consensus that exists in the EU with regard to many of its policies and the role it should assume in international affairs. Such incoherence is particularly evident in normatively contested and geopolitically intertwined areas like sexual rights and equality (ranging from nondiscrimination based on sexual and gender expression to positive rights of partnership recognition and childcare). To the extent that a common approach on LGBTI rights is developed, one can detect promotion attempts in the external policy areas in which rights promotion is formulated and diffused, namely in development and foreign aid, in enlargement and neighborhood policies, and in exchange with other international organizations. However, these come with their own politicizing issues, so that alternatives to the presently emphasized conditionality and visibility policies may provide a better way forward.

Europe’s LGBT Movement: France

Four moments can be identified in the development of LGBT activism in France: the tensions between private actions and acting publicly (1954–1974), the movement as an activist project (1974–1989), the first attempts of institutionalization (1989–1994), and the emergence of a space of LGBT activism (1994–2013). These moments are identified based on the nature of the collective action, the internal structure of the movement, the representativeness of national collectives, and the political plurality of the community of the LGBT movement. They show the nonlinear trajectory of the LGBT movement in France and confirm that the project of an LGBT movement, a structured and representative national organization, has never been fully achieved in the country.
Two characteristics of the French political and social system contribute to explain this situation: a strong and inaccessible state that transcends civil society, and the impact of Republicanism. The closure of the French state, which restricts the opportunities available to activists, has had a significant impact on activism. It not only contributes to the individualization of protest, but also leads to a radicalization of activism, a limited duration of groups over time, and a lack of centralization, institutionalization, and NGOization of social movement organizations. This closure partly results from the Republicanist ideology, which requires the state to transcend civil society groups and the particular interests they would defend in favor of so-called general will. If the development of Republican ideas has historically facilitated the development of LGBT rights, Republicanism has more recently prevented LGBT activists from articulating a specific political identity.

Regional Institutions and the European Union

European integration and regionalization have been parallel processes over the past five decades, leading to a multilevel governance system where decision-making powers are allocated across European, national, and regional governments. The upshot of both processes is that regional governments have gained representation within European Union (EU) institutions and they have gained the ability to affect EU policy through domestic institutions.
Regional governments are involved in the EU policymaking process at the EU level through two institutions: via their representatives in the Committee of the Regions and via the participation of their ministers in the Council of Ministers. Similarly, regional governments are institutionally involved with EU affairs within the member states through three institutional channels: formulation and implementation of EU Cohesion Policy, intergovernmental meetings between national and regional governments to coordinate EU affairs, and subsidiarity monitoring of EU legislation by regional parliaments.
The analysis shows that the EU’s multilevel governance system is highly asymmetric. Regional involvement in EU affairs through EU and domestic institutions is mainly restricted to powerful regions which can be predominantly found in the populous, federal, and regionalized member states from Western Europe. In addition, the analysis reveals that regional impact on EU policy is far more apparent within the member states than at the EU level. Furthermore, regional governments prefer to impact EU affairs through or in collaboration with their member state governments rather than bypassing them.
