Russian Legal System and Use of Law

The Russian legal system has a spotty reputation, both domestically and internationally. The distrust stems from well-publicized cases involving enemies of political or economic elites in which the outcome in favor of the elites is obviously predetermined. Coexisting with such cases are millions of mundane cases in which judges adhere scrupulously to the statutory law. This sort of legal dualism is not uncommon under authoritarianism. Russia’s constitution reflects this dualism. Its relevance to daily life and its capacity to constrain arbitrary state actions is questionable. Adopted in 1993, it proclaims Russia to be a state governed by the rule of law and includes a chapter with a comprehensive list of rights guaranteed to citizens which cannot be changed without convening a constitutional assembly. The constitutional court, which is a post-Soviet institutional innovation, is charged with ensuring compliance with the constitution. Amending the constitution requires consent from both the national legislature and two-thirds of the regional legislatures. The electoral dominance of the political party associated with Vladimir Putin has made this seemingly high threshold for amendments easily achievable. He has bent the constitution to his political will with multiple amendments, culminating in a set of over 100 amendments approved in 2020. The use of courts by Russian citizens and businesses has increased steadily during the post-Soviet period. As a rule, disputes are handled quickly and inexpensively. Even so, litigating is not the preferred option; Russians typically end up in court only when informal negotiations fail. As a rule, they go to court to solve practical problems rather than to advance issues of principle. The courts’ dockets are dominated by civil claims, such as family law disputes and various forms of debt collection. The straightforward nature of the procedural rules allows many litigants to represent themselves. In criminal cases, which are fewer, defendants are required to be represented by a licensed attorney (advokat). The state covers the cost of legal representation for the poor. Litigants who are dissatisfied with the outcomes of their cases can pursue appeals, culminating in the Russian Supreme Court. Citizens who believe that officials have violated their rights can pursue their claims in the stand-alone constitutional court, whose decisions serve as binding precedent. The post-Soviet era has witnessed wide ranging reforms to the legal system. Some were aimed at depoliticizing the courts. Judges are selected by a professional council dominated by judges that assesses candidates’ knowledge of law and appropriateness for the bench. They enjoy life tenure, subject to removal for cause—a process that is occasionally hijacked to remove judges who fail to toe the line in political cases. The reforms also sought to ease the heavy workload of judges by introducing a form of plea bargaining in criminal cases and opening the door to a type of summary judgment in civil cases in which defendants have conceded their culpability.


Information Processing and Digitalization in Bureaucracies

Bureaucracies and their processing of information have evolved along with the formation of states, from absolutist to welfare state and beyond. Digitalization has both reflected and expedited these changes, but it is important to keep in mind that digital-era governance is also conditioned by existing information resources as well as institutional practices and administrative culture. To understand the digital transformations of states, one needs to engage in contextual analysis of the actual changes that might show even paradoxical and unintended effects. Initially, the studies on the effects of information systems on bureaucracies focused on single organizations. But the focus has since shifted toward digitally enhanced interaction with the society in terms of service provision, responsiveness, participatory governance, and deliberation, as well as economic exploitation of public data. Indeed, the history of digitalization in bureaucracies also reads as an account of its opening. But there are also contradictory developments concerning the use of big data, learning systems, and digital surveillance technologies that have created new confidential or secretive domains of information processing in bureaucracies. Another pressing topic is automation of decision making, which can range from rules-based decisions to learning systems. This has created new demands for control, both in terms of citizen information rights as well as accountability systems. While one should be cautious about claims of revolutionary changes, the increasing tempo and interconnectedness characterizing digitalization of bureaucratic activities pose major challenges for public accountability. The historical roots of state information are important in understanding changes of information processing in public administration through digitalization, highlighting the transformations of states and new stakeholders and forms of collaboration, as well as the emerging questions of accountability. But instead of readily assuming structural changes, one should engage in contextualized analysis of the actual effects of digitalization to fully understand them.


Regulatory Governance: History, Theories, Strategies, and Challenges

Regulation, that is, rulemaking, rule monitoring, and rule enforcement, is both a key policy and legal instrument and a pillar of the institutions that demarcate political, social, and economic lives. It is commonly defined as a sustained and focused control mechanism over valuable activities using direct and indirect rules. Most frequently, regulation is associated with the activity of public independent regulatory agencies, designed to promote economic, social, risk-management, integrity, or moral goals. Since the 1990s, more and more states worldwide are establishing such agencies and placing more emphasis on the use of authority, rules, and standard-setting, thus partially displacing earlier emphasis on public ownerships and directly provided services. Alongside this rise of the “regulatory state,” the expansion of regulation is also reflected in the rapidly growing variety of regulatory regimes that involves nonstate actors, such as private regulation, self-regulation, and civil regulation. Regulatory regimes can be explained and assessed from three theoretical perspectives: public-interest theories, private-interest theories, and institutional theories. Each perspective shines a different light on the motivations of the five regulatory actors: rule-makers, rule intermediaries, rule-takers, rule beneficiaries, and citizens. Over the years, diverse regulatory strategies evolved, including: prescriptive strategies that attempt to mandate adherence in precise terms what is required from the rule-takers; performance-based strategies that set in advance only the required outcomes; and process-based strategies that attempt to influence the internal incentives and norms of rule-takers. Although it appears that regulation is here to stay as a keystone of society, it still faces fundamental challenges of effectiveness, democratic control, and fairness.


Military Coups d’État and Their Causes

There have been three waves of scholarship on military coups d’état (or simply “coups”)—the unconstitutional replacement of chief executives by military officers—since the 1960s. The first used case studies to explore why the military overthrows governments. One of its central findings was that military uprisings were an integral part of political succession in many countries. A second wave produced the “aggregate studies” that were the first to deploy cross-national databases to identify the measurable features that distinguished more from less coup-prone political systems. These studies revealed, among other things, that coups proliferated in places with a history of instability. The third and current wave of scholarship takes advantage of the development of statistical software for limited dependent variables—then unavailable, now commonplace—to recast the quantitative research on coups. Two core findings have survived disconfirmation since the start of the third wave. First, higher income countries have fewer coups, though the effects are small (and become even weaker when models only contain developing countries). Second, “political legacy effects” mean that the probability of a coup declines with time since the last military uprising. Much of the latest wave of research pinpoints factors—like coup proofing, less inequality, or the end of the Cold War—that reduce the probability of a coup. The development of ever more sophisticated statistical techniques to divine the causes of instability, nevertheless, relies on off-the-shelf data sets and coup catalogs whose validity—properly understood as accuracy—is questionable. Only a greater attention to accuracy and complementary methods promise to produce a comprehensive account of why the military topples governments in some, but not in other, places.


Military-Industrial Complexes and Their Variations

Dwight David Eisenhower delivered one final address to the American public on January 17, 1961, as he prepared to step down from the U.S. presidency. Often remembered as an inarticulate public speaker, Eisenhower surprised his audience with his clear warning that “in the councils of government, we must guard against the acquisition of unwarranted influence, whether sought or unsought, by the military-industrial complex.” Eisenhower’s words resonated with both his audience and subsequent generations because he gave voice to the growing level of popular anxiety over whether armaments’ increasing importance to national security would ultimately endow defense firms with a degree of power incompatible with liberal democracy. Although Eisenhower’s concerns about defense firms’ antidemocratic potential echoed those of policymakers and scholars since the First World War, Eisenhower’s formulation of the military-industrial complex problématique followed on the heels of earlier analytic models—notably the “merchants of death” and “garrison state” hypotheses—and preceded later rearticulations, such as that of the “iron triangle.” It is possible now, with a century of perspective on this literature, to assess which hypotheses about defense firms’ deleterious impact on society and government have been borne out by subsequent events and which have not. Within this context, many of the worst fears embodied in the earlier theories have not been borne out by subsequent events. Defense firms did not “cause” wars as per the merchants-of-death hypothesis, and democracy did not give way in states where it already existed to the authoritarian rule of “specialists of violence.” Nonetheless, the core insight of the military-industrial complex and iron triangle schools of thought—that defense industries and their allies in the military and politics will act as an interest group to promote procurement projects—has proven robust. The way that these dynamics occur, however, varies from state to state as a function of their institutions. Even though the production of armaments by defense firms headquartered in one’s state exercises a distorting effect on national politics and military procurement, few states can escape this dynamic. The national security advantages of greater supply security and enhanced military adaptation, combined with the fear that once abandoned, defense-industrial capabilities cannot be quickly reconstituted, compels most states that can produce armaments to do so. A military-industrial complex, of some form, is thus a fatality for the modern state.


Real Property Tax in Local Public Finance

The real property tax (RPT) is a major, stable revenue source for local governments to provide basic public services. The quality, quantity and reliability of public services in a locality are key indicators of the living standards. The service responsibilities require local governments to maintain stable revenues. RPT is a tax on owning and holding land and structures on land, and RPT is a very old tax, dating back to ancient times when land and products thereof were the most important assets. RPT has been used by governments of all countries throughout history, although with huge variation in formats and ways of use. Despite numerous pitfalls in its design and administration, RPT has remained a pillar of local revenue, accounting for a high percentage of total local revenue. Thus, it is important to understand RPT and its roles in local public finance. RPT was mistakenly dubbed the worst tax, a misnomer that has caused misperception of the tax that should be corrected. RPT is one essential pillar of a modern tax system. The design and maintenance of an optimal RPT should follow six principles. The complexity of RPT is with key aspects in its administration, with the weakest link in property value assessment. Exemptions and limitations add to the complexity of RPT, causing unintended consequences. From a panoramic view, RPT has adapted to changes of the society and economy; it still holds prospects as an optimal tax and remains the cornerstone of accountable and sustainable local public finance.


Left Governments and Social Movements in Latin America

The relationship between social movements and left governments in Latin America since the postwar period has evolved from top-down relationships of populism and vanguardism to more contemporary attempts to blend new social movement practices of horizontalism and direct democracy with the hierarchical structures of the capitalist state and the party system. This evolution represents a long and unfinished transformation in the character of popular struggles, which today stands at the crossroads between referring back to more traditional structures of resistance, and pushing forward to the creation of a new left that can feature radical democratic participation from below as its centerpiece.


Transparency in Public Administration

Transparency is one of the keywords of contemporary governance. It is often associated with democratic accountability, but it also carries connotations of market efficiency. Though transparency is a key concept for economics and politics, its ideational roots lie in access to government information. Transparency holds promises for increased democratization and economic performance, but these may also stand in contradiction. Coinciding with the rise of transparency as a token of responsible governance, we have witnessed rapid global diffusion of information access laws. In debates on public accountability, transparency appears as an element of both deliberation and performance, which is peculiar as these are often seen as complementary types of accountability. Moreover, increased transparency is often assumed to lead to increased citizen trust in government, but the relation of trust and transparency is more complex. Transparency also implies access to public information, which can consist of various types of documents and registries. Through digitalization, public information has become a pressing topic of interest, including as raw material for a knowledge-based economy. Public administration also manages significant amounts of personal data of citizens, raising additional concerns for privacy. While transparency and privacy are not antonyms, there is a trade-off between them. Nevertheless, transparency also appears as a means for holding government accountable for its use of registry data. Finally, transparency has become a measured element of governance indicators that are themselves an instance of transparency. As a key concept of public administration, transparency is relevant for both democracy and efficiency of governance, but it is ambiguous and even paradoxical by nature.


Arrow’s Theorem

Kenneth Arrow’s “impossibility” theorem is rightly considered to be a landmark result in economic theory. It is a far-reaching result with implications not just for economics but for political science, philosophy, and many other fields. It has inspired an enormous literature, “social choice theory,” which lies on the interface of economics, politics, and philosophy. Arrow first proved the impossibility theorem in his doctoral dissertation—Social Choice and Individual Values—published in 1951. It is a remarkable result, and had Arrow not proved it, it is unlikely that the theorem would be known today. A social choice is simply a choice made by, or on behalf of, a group of people. Arrow’s theorem is concerned more specifically with the following problem. Suppose that we have a given set of options to choose from and that each member of a group of individuals has his or her own preference over these options. By what method should we construct a single ranking of the options for the group as a whole? Any such method may be represented mathematically by a “social welfare function.” This is a function that receives as its input the preference ordering of each individual and then generates as its output a social preference ordering. Arrow defined some properties that would seem to be essential to any reasonable social welfare function. These properties are called “unrestricted domain,” “weak Pareto,” “independence of irrelevant alternatives,” and “non-dictatorship.” Each of these properties, when taken alone, does appear to be very necessary indeed. Yet, Arrow proved that these properties are in fact mutually incompatible. This troubling fact has been central to the study of social choice ever since.


Latin American Labor Regulation in the 21st Century

The labor market of the 21st century is evolving at a rapid pace, making traditional manufacturing and agricultural jobs increasingly precarious and generating significant pressure for turnover, retraining, and adaptation by workers. Latin America’s labor regulation, adopted in the middle of the 20th century to foster industrial development and incorporate urban workers, has been slow to adapt to these conditions. Its restrictive and costly hiring and firing rules offer stronger protections than in many other parts of the world, but they often apply to a diminishing minority of laborers. Despite a few exceptions, once-strong unions have been hollowed out in the region, and workers have become increasingly atomized in their job seeking. The region’s educational systems are plagued by underinvestment, and they struggle to provide the needed technical skills that could galvanize investment that would provide higher-wage employment. Large segments of the workforce—a majority in most countries—find themselves in the informal sector, in jobs that are not registered with the state and that do not make contributions to pensions and social security systems. Why has Latin America—a region endowed with a variety of natural resources and a resilient entrepreneurial spirit—exhibited these patterns in its labor market regulation? The answer lies in an overlapping nexus of economic and political influences in the region. In this complex mix, one strand of scholarship has documented the lasting and recurrent alliance between organized labor and political parties on the left. Another strand has highlighted the concentrated power of business interests—both local and transnational—that have had the power to shape policies. And a third body of research concentrates on the electoral dynamics that have given rise to a growing set of politically motivated policies that seek to support informal sector workers, but may incentivize their remaining in that status. Finally, considerable attention has been given to the under-resourced state agencies that are not adequately monitoring labor regulations, allowing for widespread evasion of required payroll taxes. A change-resistant cycle has predominated in the region, in which protected insiders in the unionized sectors seek to preserve a set of protections that apply to a shrinking few, while politicians court support among outsiders with direct benefits that address immediate needs but have not yet achieved long-term or intergenerational change. Business interests have largely benefited from the status quo of labor law evasion and social security avoidance, so they have been slow to invest in upgrading the workforce or changing technology that would inspire additional investment in education. Addressing this situation will require efforts at both the political and economic levels, perhaps loosening the partisan ties that lock in preferential policies, as well as increasing the skill levels that would attract higher-tech industries and higher-paying jobs.
